Terms of Service for Get Vitals App

Welcome to Get Vitals. These Terms of Service ("Terms") govern your access to and use of the Get Vitals mobile application and related services. By using our app, you agree to these Terms. Please read them carefully.

For information about how we collect, use, and protect your data, please see our Privacy Policy.

1. Acceptance of Terms

By downloading, installing, or using the Get Vitals app, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use the Get Vitals app.

2. Eligibility

You must be at least 18 years old to use the Get Vitals app. By using the app, you represent and warrant that you meet this age requirement.

3. Subscriptions and Payment

3.1 Subscription Plans

Get Vitals offers various subscription plans with different features and pricing. When you subscribe, you agree to pay the fees associated with your selected plan.

3.2 Free Trials

We may offer free trial periods for certain subscription plans. You will not be charged during the free trial period. If you do not cancel before the end of your free trial, your subscription will automatically convert to a paid subscription, and you will be charged the applicable subscription fee.

3.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing cycle (monthly or yearly) unless you cancel it before the renewal date. You will be charged the then-current subscription fee for the renewal period.

3.4 Payment Processing

Payments are processed through the Apple App Store or Google Play Store. You agree to abide by the payment terms and conditions of the applicable platform. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

3.5 Price Changes

We reserve the right to change our subscription fees at any time. Any price changes will take effect at the start of your next billing cycle after we provide you with notice. If you do not agree to the price change, you may cancel your subscription before the new price takes effect.

3.6 Cancellation

You may cancel your subscription at any time through your device's subscription settings (Apple App Store or Google Play Store). Your cancellation will take effect at the end of your current billing period, and you will retain access to premium features until that time.

3.7 Refunds

Refund requests are subject to the policies of the Apple App Store or Google Play Store. Generally, we do not offer refunds for partial subscription periods. If you believe you are entitled to a refund, please contact us via our Support Contact page.

4. User Accounts

To access certain features of the app, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

You agree to provide accurate, current, and complete information when creating your account.

5. Acceptable Use

You agree not to:

  • Use the app for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any portion of the app or related systems
  • Interfere with or disrupt the app's functionality or servers
  • Reverse engineer, decompile, or disassemble any part of the app
  • Use the app to transmit viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation with anyone
  • Share your account credentials with others

6. User-Generated Content

6.1 What is User-Generated Content

Get Vitals allows users to share content, including but not limited to nurse stories, advice, experiences, and other contributions ("User Content"). By submitting User Content, you agree to the following terms.

6.2 Your Responsibilities for User Content

CRITICAL: When sharing stories, advice, or any content, you MUST NOT include:

  • Patient names, initials, room numbers, medical record numbers, or any information that could identify a specific patient
  • Specific dates, times, or locations that could be used to identify patients or incidents
  • Protected Health Information (PHI) as defined by HIPAA
  • Names, photos, or identifying information about other nurses, doctors, or healthcare workers without their explicit consent
  • Specific hospital names, unit names, or facility details that could identify individuals
  • Any information that would violate patient confidentiality, HIPAA regulations, or your employer's policies

You represent and warrant that any User Content you submit:

  • Does not violate any laws, including HIPAA and patient privacy laws
  • Does not infringe on any third party's rights (intellectual property, privacy, publicity, etc.)
  • Does not contain false, misleading, or defamatory information
  • Does not contain hate speech, harassment, or discriminatory content
  • Is your original content or you have the right to share it

6.3 Moderation and Content Review

While we make reasonable efforts to moderate and review User Content:

  • We cannot guarantee that all content has been reviewed before it appears in the app
  • We cannot guarantee that User Content is accurate, appropriate, or compliant with all laws
  • We reserve the right to remove, edit, or reject any User Content at any time without notice
  • We may remove content that we believe violates these Terms, even if it does not
  • Moderation does not make us liable for User Content or guarantee its quality or safety

6.4 No Liability for User Content

Get Vitals is NOT responsible or liable for any User-Generated Content, including but not limited to:

  • HIPAA violations or disclosure of protected health information by users
  • Stories or advice that identify patients, nurses, or other individuals
  • Inaccurate, misleading, or harmful advice shared by users
  • Content that violates employment policies, confidentiality agreements, or other legal obligations
  • Defamation, harassment, or other harmful content posted by users
  • Any consequences users face for content they share (including termination, legal action, or professional discipline)

You are solely responsible for the content you share and any consequences that result from sharing it.

6.5 License to Use Your Content

By submitting User Content, you grant Get Vitals a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute your content within the app and for promotional purposes. You retain ownership of your content.

6.6 Reporting Inappropriate Content

If you encounter User Content that you believe violates these Terms, contains identifying information, or is otherwise inappropriate, please report it immediately using the reporting features in the app or via our Support Contact page.

7. Burnout Assessment and Research

7.1 Purpose of Burnout Assessment

Get Vitals provides a burnout assessment tool that measures various dimensions of burnout, including:

  • Emotional Exhaustion
  • Depersonalization
  • Personal Accomplishment

IMPORTANT: This assessment is designed to give you an indicator of where you are in your burnout journey. It is NOT medical advice, a medical diagnosis, or a substitute for professional evaluation.

7.2 Assessment Limitations

By using the burnout assessment, you acknowledge and agree that:

  • The assessment is a self-report tool and provides general indicators, not definitive diagnoses
  • Results are not perfect and may not fully capture your individual situation
  • The assessment should not replace consultation with mental health professionals, physicians, or counselors
  • Assessment scores are meant for personal awareness and reflection purposes only
  • Get Vitals is not responsible or liable for any decisions you make based on your assessment results
  • Get Vitals is not responsible or liable for the accuracy, completeness, or interpretation of your results

7.3 Research and Data Use

By completing the burnout assessment and using Get Vitals, you agree that:

  • Your assessment scores and related data may be used for research purposes to study burnout in healthcare workers
  • This research aims to help solve burnout and improve mental health support for nurses and healthcare professionals worldwide
  • Your participation contributes to advancing the field of burnout prevention and management
  • All research use of your data will be conducted in accordance with our Privacy Policy

7.4 Privacy and Anonymized Data

Your individual assessment scores and personal information remain private and confidential.

However, you agree that Get Vitals may use your data in the following ways:

  • Anonymized Statistics: Your scores may be included in anonymous, aggregated statistics for promotional materials, research publications, and educational purposes
  • Comparative Benchmarks: Your anonymized data may be used to create comparison metrics (e.g., "How do ER nurses compare to ICU nurses?" or "How do your scores compare to other nurses in your specialty?")
  • Aggregated Insights: Your data may be combined with other users' data to identify trends, patterns, and insights about burnout in healthcare
  • Product Improvement: Aggregated data helps us improve the assessment tool and app features

All anonymized and aggregated data is stripped of personally identifiable information. No individual user can be identified from these statistics or comparisons.

7.5 Opt-Out Options

If you do not wish to have your assessment data used for research or aggregated statistics, you may opt out by disabling "Usage Trends" in your app settings or by contacting us via our Support Contact page. Opting out will not affect your ability to use the app or view your personal assessment results.

8. Intellectual Property

8.1 Ownership

The Get Vitals app, including all content, features, functionality, and materials (text, graphics, logos, audio, video, software), is owned by Get Vitals and is protected by copyright, trademark, and other intellectual property laws.

8.2 Audio Content and Copyrighted Materials

Get Vitals provides various audio content within the app, including but not limited to:

  • Shift Recovery audio sessions
  • Reset meditations and guided audio
  • Voice-guided relaxation exercises
  • Mindfulness and wellness audio content

All audio files, recordings, and voice content are copyrighted by Get Vitals and are protected by U.S. and international copyright laws.

8.3 Prohibited Uses

You are granted a limited, non-exclusive, non-transferable license to access and use the app and its content for personal, non-commercial use only. You may NOT:

  • Download, copy, record, or extract audio files from the app
  • Redistribute, share, or transmit any audio content to third parties
  • Use any audio content outside of the Get Vitals app
  • Sell, rent, lease, or sublicense any app content
  • Create derivative works based on our audio or other content
  • Use screen recording, audio capture, or any other method to copy or reproduce our content
  • Remove or alter any copyright notices, watermarks, or proprietary markings
  • Use any content for commercial purposes or public performance

8.4 Enforcement

Unauthorized use, reproduction, or distribution of any Get Vitals content, including audio files, constitutes copyright infringement and may result in:

  • Immediate termination of your account and access to the app
  • Legal action, including civil and criminal penalties under copyright law
  • Claims for damages and attorney's fees

If you become aware of any unauthorized use or distribution of Get Vitals content, please report it via our Support Contact page.

9. AI-Powered Features and Shift Debrief

9.1 AI-Generated Content

Get Vitals includes AI-powered features, including the Shift Debrief chat functionality. These features use artificial intelligence to provide emotional support, reflection prompts, and wellness guidance.

IMPORTANT DISCLAIMER: AI-generated responses are NOT professional therapy, counseling, or medical advice.

9.2 Limitations of AI

By using AI features, you acknowledge and agree that:

  • AI responses may contain errors, inaccuracies, or inappropriate content
  • AI cannot replace human judgment, professional therapy, or medical care
  • AI responses are generated based on patterns and do not constitute personalized professional advice
  • The AI does not have access to your medical records or complete health history
  • You should not rely on AI-generated content for making decisions about your health or safety

9.3 Your Responsibility

When using AI features, you are responsible for:

  • Using your own judgment when evaluating AI-generated responses
  • Not sharing sensitive personal health information or identifiable patient information
  • Not using the AI chat as a substitute for emergency services or crisis intervention
  • Seeking professional help from qualified therapists, counselors, or medical providers when needed

9.4 Reporting and Continuous Improvement

We are committed to maintaining the quality and safety of our AI features. To support this:

  • We provide mechanisms within the app for you to report inappropriate, harmful, or inaccurate AI-generated content
  • We encourage you to use these reporting features whenever you encounter problematic responses
  • Reported content and user feedback help us identify issues and continuously improve the AI's performance
  • Data from these reports may be used to retrain and refine our AI models to better serve our users
  • We review reported content to identify patterns and make necessary adjustments to the AI system

Your feedback is valuable in helping us create a safer and more effective support tool for all nurses using Get Vitals.

9.5 No Liability for AI Content

To the fullest extent permitted by law, Get Vitals is not responsible or liable for:

  • Any AI-generated content, responses, or suggestions
  • Any actions you take based on AI-generated content
  • Any harm or damages resulting from your use of or reliance on AI features
  • Any errors, omissions, or inaccuracies in AI-generated responses
  • The inability of AI to detect or respond appropriately to crisis situations

The AI is designed to be supportive and helpful, but it is a tool—not a replacement for human care and professional support.

10. Medical Disclaimer

IMPORTANT: Get Vitals is a wellness and mental health support tool. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

  • The app does not provide medical advice or emergency services
  • If you are experiencing a medical emergency, call 911 or your local emergency number immediately
  • If you are experiencing thoughts of self-harm or suicide, please contact the National Suicide Prevention Lifeline at 988 or the Crisis Text Line by texting HOME to 741741
  • Always seek the advice of qualified health providers with any questions regarding your mental or physical health
  • Never disregard professional medical advice or delay seeking it because of something you have read or experienced in the app

11. Limitation of Liability

To the fullest extent permitted by law, Get Vitals and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the app
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of the app
  • Any bugs, viruses, or other harmful code that may be transmitted through the app
  • Any errors or omissions in any content or any loss or damage incurred as a result of your use of any content

12. Disclaimer of Warranties

The app is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the app will be uninterrupted, secure, or error-free, or that any defects will be corrected.

13. Termination

We reserve the right to suspend or terminate your access to the app at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

Upon termination, your right to use the app will immediately cease. You may also delete your account at any time by following the instructions in the app or via our Support Contact page.

14. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. We will notify you of any material changes by posting a notice in the app or sending you an email.

Your continued use of the app after any changes to these Terms constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
